Bill Overview

Analyzed Economic Effects

4 provisions identified: 3 benefits, 0 costs, 1 mixed.

Patients can join multiple transplant lists

The law removes New York’s ban on being on more than one transplant waiting list. You can join multiple waiting lists run by different New York organ procurement organizations for the same organ. This can increase your chances of getting an offer sooner. The change takes effect immediately.

Cross region sharing for hard to match patients

Organ procurement organizations can share organs across areas under federal and state rules. This includes standards to help highly sensitized patients, such as people with prior blood transfusions, immunizations, past pregnancies, or a failed kidney transplant. Organizations can also share under agreements approved by the state commissioner. These steps widen the pool of possible matches.

Local lists guide organ offers, no favoritism

When an organ is recovered in New York, the local organ procurement organization uses its own waiting list to offer it. Doctors still decide if a patient is a suitable match. If an organ comes from another area, it follows the list where it will be implanted. Organizations may not favor patients based on a transplant center’s past performance or ties to a donor hospital.

Donors can name who gets their organ

An individual donor can name the person who will receive their organ. Directed donations are allowed in New York. This rule is in effect now.
