Bill Overview

Analyzed Economic Effects

3 provisions identified: 1 benefits, 1 costs, 1 mixed.

Junkyards need tribal OK on reservations

Junkyards, auto graveyards, and dumps on reservation land need tribal council permission. Any lease or contract without that permission is void. After a judge finds someone is an intruder, the judge can order an intruding business, junkyard, or drug‑trafficking materials seized or removed. The tribe must consent before a seizure or removal.

Stronger trespass enforcement on tribal lands

Nonmembers and unauthorized guests cannot enter, live, or run a business on tribal land. When the tribe’s designee applies in writing, the county DA files a case. A judge gives notice, decides if the person is an intruder, and orders the sheriff to remove them within 10 days. If the person was removed before, the judge also jails them for 90 days. The tribe’s intruder designation is final, and the State pays sheriffs reasonable costs to carry out these warrants.

Law enforcement agreements with Seneca Nation

At the Seneca Nation’s request, New York leaders can sign agreements on criminal law enforcement on Seneca lands. These pacts can define crimes and penalties, deputize officers, and set extradition rules. New York courts must follow these agreements in criminal cases from Seneca lands.
