When a court decides custody while an order of protection is active, it must first review safety records. The court checks the sex offender registry, the statewide orders‑of‑protection registry, related Family Court Article 10 decisions, and any Family Court warrants. This applies when custody may go to either parent or a close relative within the second degree. The law also clarifies this section does not let the court place a child in foster care or an institution. One paragraph in this section is repealed. These changes apply starting 30 days after the law became law.
