License loss rules and appeals

The department can deny, suspend, or revoke a license after notice and a hearing. Reasons include false applications, unsanitary conditions, adulterated food, missing records, rule violations, or a manager’s felony conviction. If your license is refused or revoked, you can ask a court to review it under Article 78. You must file within 30 days after the decision is served.

Tougher penalties and shutdown powers

Inspectors can enter places where food is sold or stored at reasonable hours to perform inspections. Running without a license is a separate violation for each day and can bring penalties under state law. If a store fails three inspections in a row, the department can order it to stop operations until it passes, or suspend or revoke its license. The commissioner can also go to court for orders to enforce the law without first proving other remedies are enough.

Licenses and fees for food businesses

Most stores, restaurants, and food warehouses must hold a state license unless already covered by approved state, local, or USDA programs. Apply on the commissioner’s form by December 1 every other year for the period that starts January 1. Licenses last two years. Fees are $250 for stores and restaurants, and $400 for warehouses. New chain-store licenses must share the same expiration date across the chain. These licensing rules take effect 120 days after the law became law.

Stronger food safety checks and postings

The state inspects every retail food store at least once every 12 months. If a store fails two inspections in a row, it gets checked at least every six months until it passes twice. Stores and restaurants must post the date and results of the most recent sanitary inspection near each public entrance and give copies on request. The department assigns at least one retail food specialist per zone, and specialists get extra training to help fix chronic issues and improve pest control.
