Stricter produce fee rules protect growers

Effective immediately, New York raises the Produce Security Fund's fee suspension threshold from $4 million to $6 million. The fund balance is checked 120 days before the next license year. The commissioner must stop collecting fees when the balance exceeds $6 million, unless either safeguard below applies. Fees continue if the commissioner reasonably believes pending claims could bring the fund below $6 million. Fees also continue for that year if inflation leaves producers with less protection than the suspension rule calls for.
