New York now treats medical and health insurance information as personal identifying information. Theft or misuse of this data can be charged under the state’s identity‑theft crimes. The law also makes clear which identity‑theft sections use this definition. It cleans up wording in the offense sections; the $500 and $2,000 thresholds do not change.

Clearer rules on medical data breaches

The law defines medical information and health insurance information in New York’s data breach law. Examples include your medical history, diagnosis, policy or subscriber ID, and claims or appeals history. It also removes some 2024 text in the General Business Law and State Technology Law to align wording. Businesses covered by the breach law must use these definitions when safeguarding data and notifying you after a breach.
