Fines for breaking kratom label rules

Businesses that violate these kratom label rules face civil fines. A first violation can cost up to $500. A second or later violation can cost up to $1,000. The penalties apply to any person or company that makes, distributes, sells, or offers kratom at retail in New York.

New warning labels for kratom sellers

In New York, you cannot make or sell kratom unless the package has a full warning label. The label must list the maker’s name and address, all ingredients, and say that sales to people under 21 are prohibited. It must warn against use while pregnant or breastfeeding, advise talking to a health professional, and note addiction and drug‑interaction risks. It must state whether it contains semi‑synthesized or synthesized kratom chemicals, and show the amounts of mitragynine and 7‑hydroxymitragynine. It must also say: “These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease.” and “Keep out of reach of children.” Kratom includes the Mitragyna speciosa plant and processed or synthetic kratom chemicals.
