Prevailing wages for off-site fabricators

Workers who make project‑specific parts for a public job must get the county prevailing wage, even if they work off‑site. Contractors and subs on the job must pay it; if federal wage rules apply, those rules control. Custom fabrication means items made only for that job, like wall panels, woodwork, ducts, rebar cages, wiring, plumbing, and insulation. Stock or off‑the‑shelf items are not covered. Highways, vehicles, or watercraft used to move people are excluded, but rest‑area and transit‑station electrical, plumbing, HVAC, and insulation are covered. Residential jobs exempt under section 224‑a stay exempt.

Reporting and payroll rules for fabricators

Contractors and subs using off‑site custom fabrication must keep certified payrolls and follow Labor Law sections 220‑i and 220‑j. If they plan to use custom fabrication, they must report it to the agency running the contract. Reports must name the contract, the fabricator and location, and describe the custom work. The agency must also report fabrication details, costs, and estimated workers to the fiscal officer. These records follow the fiscal officer’s format and can be released under the Public Officers Law.
