Insurers and health plans must tell you before using a card or EFT that charges you a fee. They must offer a fee-free way to pay you. You or your agent have 30 days to choose. If you do not choose, they must use the fee-free method, or another fee-free method if needed to meet payment timelines. They cannot charge a fee just to send an EFT unless you elected that method. Your choice stays in place until you change it in writing. If a payer uses a payment vendor, the vendor must follow these rules. New or changed contracts cannot waive these rights. Rules about vendors you hire yourself do not change.
Some parts of the law take effect right away. Many contract rules start 180 days after the law becomes effective and apply to contracts issued, renewed, or changed on or after that day. Sections 1 through 3 take effect on the same date and in the same manner as a 2025 law that also updates these payment rules.
