The law lets spouses seek no-fault separation after six months instead of a year. You can file if you lived apart under a court separation decree for six months and followed its terms. Or you lived apart for six months under a written separation agreement that was signed and acknowledged like a deed and filed with the county clerk. A short memo with both spouses’ names and addresses, the marriage date, the agreement date, and the acknowledgment date may be filed instead. You can also use no-fault if the marriage has been broken beyond repair for six months and one spouse swears to it, but the case does not move ahead until spousal support, child support, custody and visits, and legal fees are settled or decided by the court.
The law takes effect on the 60th day after enactment. It applies to separation cases started on or after that day.
