The law bans menstrual products sold or given away in New York from having any restricted chemical that was intentionally added, at any level. This applies to retail and wholesale sales and promotional giveaways. The ban starts when the law takes effect, 12 months after enactment.
The Health Department, with the Environmental Conservation Department, sets numeric limits for restricted chemicals in menstrual products. They must set these limits within one year after the law takes effect and use the lowest feasible level. Products at or above those limits are banned two years after the limits are set, and no later than January 1, 2029. The state reviews the limits at least every five years to see if they should be lower.
The law defines key terms for enforcement. It explains what counts as a menstrual product. It defines “restricted substances,” including examples like lead, mercury, formaldehyde, triclosan, toluene, talc, certain phthalates and parabens, and PFAS. It defines PFAS as a class of fluorinated chemicals. It also defines “intentionally added” ingredients to include fragrance, color, flavor, and intended breakdown products.
