120-hour hold before guns returned

A seized gun or license is not returned for at least 120 hours. After that, it is returned only if there is no order of protection, extreme risk protection order, or other court order blocking possession; no disqualifying criminal charge or conviction; and a written finding says there is no legal barrier. The court, or if no court is involved the licensing authority or custodian, orders the return. If these are not met, the items are not returned and may be disposed of under state law.

Police must remove guns at domestic calls

During a family offense call, police can take any gun they see or lawfully find at the scene. Police must take a weapon from anyone arrested or reasonably suspected in the incident. Police must also take a visible or lawfully found weapon if the victim says yes to danger questions on the Domestic Incident Report, or an officer believes removal is needed to protect people. Officers also take any related gun license and deliver the items to the proper authority. This covers firearms, rifles, shotguns, stun guns, disguised or imitation guns, and antique or muzzle-loading guns.
