The law treats off-site custom fabrication as public work, not simple material supply. Workers who make these custom pieces must be paid the on-site prevailing wage for the county where the project is, even if the work happens off-site or out of state. This applies only when the items are a significant part of the project and required by the contract; “significant” means modules delivered with little left but installation or assembly. “Custom fabrication” includes wall panels, woodwork, electrical, plumbing, HVAC ducts, rebar cages, and mechanical insulation. This state rule does not apply when federal wage rules cover the project. It applies to contracts put out to bid on or after the law’s effective date.
Contractors and subcontractors who use off-site workers for custom fabrication on a public work must keep certified payrolls. They must give original, signed payroll records to the Department at least once a year and when asked. They must also follow existing payroll rules in section 220‑i. This applies to contracts put out to bid on or after the law’s effective date.
