Hygienists can treat patients without on-site dentist

The law creates a new role: “registered dental hygienist, collaborative practice.” Hygienists in this role may provide dental hygiene services under a written agreement with a licensed dentist and written protocols. They may do services allowed under general supervision without a prior dentist exam. In approved settings like hospitals, equipped schools, FQHCs, long-term care, group homes, veteran facilities, temporary housing, prisons, drug treatment centers, and domestic violence shelters, a dentist does not need to be on site.

Start date and agency rules for hygienists

The law takes effect 18 months after it becomes law. The Commissioner issues rules that define what functions dental hygienists may perform, consistent with their training and license.

New rules and caps for hygienist collaboration

Collaborative agreements must be written and signed by the dentist, the hygienist, and the setting, and reviewed each year. Agreements must address care for medically compromised patients, set age- and procedure-specific rules, and say how often hygiene services and dentist exams should occur. Before care, the hygienist must give patients a written notice that hygiene services do not replace a dentist exam. If they refer a patient, they must complete a referral form and send a copy to the collaborating dentist. To register, a hygienist must apply, pay a fee, have at least three years and 4,500 hours of practice, and finish an 8-hour course on emergencies, risk, law, and ethics. A hygienist may have only one collaborative agreement at a time. A dentist may work with up to six collaborative hygienists, unless the department grants a public-health exception.
