Court access to a neighbor's property

The law lets a property owner or lessee ask a court for access to a neighbor’s land when work cannot be done without it and the neighbor refused. Refusal includes no reply within 60 days after more than one certified‑mail notice. Entry is only for listed tasks like surveys, monitoring devices, scaffolding and shoring, needed supports and weatherproofing, brief airspace use, rooftop moves required by law, and staging. Give reasonable prior notice (except emergencies). If work will place equipment or structures next door, give the neighbor plans, surveys, engineering reports, and proof of insurance first. You and your contractors must keep commercial general liability insurance and name the neighbor and lessees as additional insureds. You must pay for any actual damage and for the neighbor’s loss of use or drop in value; the court can set fair terms, consider past noncompliance, order fee reimbursement, and require schedule dates and extensions through the court.

No court access to state property

Courts cannot grant access when the next‑door property is owned, leased, or occupied by a state entity. The law names the Metropolitan Transportation Authority (MTA) and its affiliates and subsidiaries.
