Energy supplier bills must show comparisons

If you buy energy from an energy services company (an ESCO), the first page of your bill shows side-by-side prices for the last period: what the ESCO charged and what your local utility or municipality would have charged. The bill also lists prices for any extra energy products. Once a year, you get a 12-month comparison that clearly says if you saved money or paid more. This rule applies even if the utility sends your bill.

Stronger enforcement and your right to sue energy suppliers

The Attorney General can sue energy suppliers that break this law and seek up to $1,000 per violation, plus costs and lawyer fees. Courts can also order restitution to customers. If you are harmed, you can sue to stop the practice and recover your actual damages or $500, whichever is more. If the violation was willful or knowing, damages can be tripled up to $10,000, and a winning customer can get attorney’s fees. Regulators (PSC and LIPA) can still limit or revoke an ESCO’s eligibility and set extra marketing rules that do not conflict with this law.
