The Commissioner of Mental Hygiene writes the warning text with the Health and Education Commissioners. The text and display rules must rely on medical and social research and consider users under 18. The Commissioner sets when, how often, and how long the warning shows and can update these rules each year. An annual public report explains the research, changes, and any recommended law updates.
Platforms must show a state-approved warning every time you use addictive features like autoplay, infinite scroll, like counts, or push alerts. The warning must use only the words set by the Commissioner of Mental Hygiene and appear as that office requires. Platforms cannot hide the warning, put it only in the terms, shorten how long it shows, or add clutter to weaken it. They also cannot block features, lower quality, or charge you more just because the warning appears. Only changes needed to follow this law are allowed.
The New York Attorney General writes the rules and enforces this law. The Attorney General can ask courts to stop violations and seek restitution, disgorgement, damages, and civil penalties up to $5,000 per violation. The Attorney General keeps a public website to take complaints. The law covers platform activity that happens in whole or part in New York, and use outside the state is treated as outside. The law also stays consistent with federal children’s online privacy rules.
The law takes effect 180 days after the Attorney General issues the needed rules. The Attorney General must notify state drafters when rules are issued. The Attorney General can add or change rules before the law takes effect.
