Bullying banned at private schools

Students at nonpublic K–12 schools may not bully or harass others on school property or at school events. The law also defines what counts as school property and school functions. It defines bullying, harassment, and cyberbullying, including online conduct that affects the school environment.

Free speech and religion rights protected

The law does not override free speech or the free exercise of religion. Anti-bullying rules must respect rights protected by the U.S. and New York Constitutions and state law.

Private schools must share anti-bullying policy

Every nonpublic school must have a written, plain-language, age-appropriate anti-bullying policy. The school must post it online or on a parent or student portal and share it each year with staff, parents, and students. The policy must define bullying, explain how to report it, how investigations work, how incidents are documented, and how victims are told the final result.

Quick bullying reports and school action

If a school employee sees bullying or gets a report, they must tell the principal within one school day. They must file a written report within two school days after the oral report. The principal or designee must investigate quickly, tell the victim the finding, and take steps to stop it and keep the student safe. The law protects people who report or help from retaliation.
