Kratom retailers: 21+ sales and ID checks

Retailers cannot sell or give kratom to anyone under 21. Each illegal sale can cost up to $500. Stores must post a clear sign: "SALE OF KRATOM TO PERSONS UNDER TWENTY-ONE YEARS OF AGE IS PROHIBITED BY LAW," on a white card with red letters at least one‑half inch tall. Buyers must show an acceptable photo ID (like a U.S. or Canadian driver’s license, passport, U.S. military ID, or other government or school photo ID showing age 21+). If someone looks 25 or older, you may skip ID, but looks alone are not a legal defense. You may scan an ID as a condition of sale and must deny the sale if the scan data does not match or appears false. A successful scan plus a valid government ID can be a defense in some administrative cases, but not in civil or criminal court. Kratom means any part of the Mitragyna speciosa plant or products made from it.

Privacy rules for scanned customer IDs

If you scan an ID, you cannot sell or share the scan data. You may release it only with a court-ordered subpoena or when a law allows it. You may keep only the person’s name, date of birth, ID number, and ID expiration date. Each unlawful disclosure can cost up to $1,000 per violation.
