If you filed a timely, fully sworn World Trade Center notice, that filing counts as evidence that you have a qualifying WTC condition. For retired or vested members later found to have a qualifying WTC condition, the law presumes the disability was caused by duty and would have kept you from working at that time. The Police Pension Fund board can overturn these presumptions only with competent evidence approved by a quorum. The board can reclassify your status to accidental disability retirement, effective on the reclassification date. If reclassified, you keep the retirement option you already chose, including any survivor choices.
