Union Vale can lease parkland for tower

The law lets the Town of Union Vale stop using a small part of its park and lease it to Homeland Towers for a cell tower. The lease must be at fair market value and can last up to 30 years. The town may grant a 12‑foot‑wide, about 470‑foot access and utility easement that stays open to the public and usable for park purposes. All lease money must fund park upgrades or buying more parkland, and the town must also invest at least the easement’s fair market value in those projects. If the tower use ends, the lease and easement end, the tower and road are removed, and the land returns to park use. If federal money was used for the park, the town cannot proceed until it follows federal rules and provides replacement land of equal value and usefulness.
