Union Vale funds and restores parks

Union Vale must use all tower lease money for major park and recreation improvements or to acquire more facilities. It must also dedicate at least the fair market value of the access and utility rights to these purposes. The law sets no dollar amount. If the land stops serving the authorized tower use, the lease ends and the land returns to public park use. The access rights end, the tower and road must be removed, and the property must be restored to its prior state for park and recreation use.

Union Vale allows a parkland tower lease

Effective immediately, Union Vale can lease 5,250 square feet (0.120 acre) of parkland to Homeland Towers for a wireless tower. The parcel is east of Deforest Lane in Beekman, Dutchess County. The lease must be at fair market value, last no more than 30 years, and follow town-approved terms. The town can also grant access and utility rights along an existing road, 12 feet wide and 470 feet long. This route must stay open to the public and usable for park purposes. If federal funding or assistance supported the parkland, the town must meet federal requirements before changing its use. These include satisfying the Interior Secretary that replacement land has equivalent fair market value and usefulness.
