Beginning April 1, 2010, non-public nursing homes face limits on taking out equity or moving assets. Taking more than 3% of the most recent annual patient-care revenue needs the health commissioner’s written approval. If the facility met minimum staffing levels for the past two quarters, up to 5% is allowed with prior written notice. Requests or notices must use the department’s form and be sent by certified or registered mail. The commissioner decides within 60 days and reviews finances, distress signs, unpaid amounts to the state, and serious care citations. After a hearing, the commissioner can order assets replaced and charge up to a 10% penalty for unauthorized withdrawals.
The law creates a Nursing Home Worker Recruitment and Safety Fund. All fines and civil penalties under the staffing law go into this fund. The fund can also get other state money and gifts, and any interest stays in the fund. The health commissioner gives grants to nursing homes to improve jobs, hiring, and staff safety. When awarding money, the commissioner considers a facility’s census and its rate region and must set program rules. Payments need a comptroller audit and vouchers the health commissioner approves.
