The law sets one statewide phone number to report child abuse or neglect, open 24/7. Mandated reporters get a special unlisted phone and a fax line, and can check for prior reports. The Office of Children and Family Services uses bias‑reduction steps, then sends reports right away to the local child protective service, with the caller’s name, contact, and any prior reports. Reports are not rejected just because the caller cannot name a perpetrator. The Office flags serious cases (sexual abuse, a child’s death, or other court‑defined abuse) and repeat reports: when a mandated reporter alleges physical harm within six months and there are two other indicated or pending reports for the same child, sibling, or household. Local child protective service plans still apply.
Before a report is sent to a local child protective service, the caller must give their name and contact information. If a caller declines, the register connects them to a supervisor to explain confidentiality protections. If they still decline, the supervisor offers the HEARS Family Line and community services, and warns that knowingly false or retaliatory reports can be a crime under Penal Law 240.50(4). For people who are not mandated reporters, the register and the commissioner keep the reporter’s identity confidential, unless the reporter agrees, a judge orders it, or a specific law allows it. A court can issue a protective order if disclosure would endanger the reporter, and the commissioner can block release if it would harm safety or interests of the reporter, a cooperating person, or their agency. People named in a report can still request a copy of the record, but the reporter’s identity is withheld unless the law allows it. These special identity protections do not apply to mandated reporters.
Most of this law takes effect now. Section one starts 180 days after the law became effective.
