Accuracy checks and malfunction defense

Each camera must pass a self‑test every day it is used and have an annual independent calibration with a signed certificate. Operators must complete training and sign daily setup logs, which the city keeps for related cases. The city must post advance warning or speed signs that meet MUTCD rules. If a camera was malfunctioning at the time, you can use that as a defense.

Defenses for stolen or leased cars

You are not liable if your car or plates were reported stolen and not yet recovered; mail a certified police report to the Parking Violations Bureau. If you lease out the car and filed required info before the ticket, you can shift liability by giving the lessee’s correct details within 37 days. If someone drove without your consent, you are not fined, and you can seek repayment from the driver.

City reporting and purchasing rules

If the city runs the program, it must study it and file a report by June 1 each year on locations, crashes, violations, fines, costs, and adjudication results. The city must follow state competitive bidding rules when buying or leasing camera equipment.

How and when tickets are mailed

The city must mail a notice within 14 business days for in‑state owners, or within 45 business days for out‑of‑state owners. The notice must show your name and address, plate number, location, date and time, camera ID, and at least two time‑stamped rear images, plus the charging certificate. The Mount Vernon Parking Violations Bureau handles contests and decisions. A record of mailing counts as basic proof it was sent.

Mt. Vernon school‑zone speed cameras

Mount Vernon may use speed cameras in up to 20 school zones. They run on school days during school hours and one hour before and after, and during student activities plus 30 minutes. If your car, with your permission, is over 10 mph above the limit, you as owner must pay up to $50 (you are not liable if the driver is convicted), plus up to $25 if you do not respond on time. This is a civil ticket, not a conviction; it does not go on a driving record or affect insurance. Drivers can still face regular speeding charges. The program starts 30 days after enactment and ends December 1, 2031.

Privacy rules for camera images

Images are used only to decide liability and to notify the named owner or operator. The system should avoid showing faces or what is inside a car. Images are destroyed after the case ends or one year after the notice, whichever is later. The public cannot get these images, but an owner/operator can see them, and they can be released with a warrant or judge‑signed subpoena in certain criminal cases.
