Anyone who enters into, or makes you enter into, an unfair real estate service contract violates New York’s deceptive acts law. You can use consumer‑protection remedies to seek relief. The Attorney General can send a cease‑and‑desist letter and, after the timeline in that letter, seek an injunction on at least five days’ notice. The court can stop the conduct without proof of actual injury and can fine up to $1,000 per violation.
The law makes some long‑term real estate service contracts unenforceable. It covers contracts not to be performed within two years that claim to run with the land, let the service be assigned without your consent, try to create a lien or other property security, or are certain listing agreements defined in state law. These contracts cannot be enforced against you or future owners. Common contracts remain valid, including home warranties, insurance, options or rights of first refusal, HOA documents and repair agreements, mortgages, UCC security agreements for personal property or fixtures, and regulated utility service contracts. The protections begin 90 days after enactment.
Unfair real estate service contracts cannot be recorded in county land records. If one is recorded, it does not count as notice to a good‑faith buyer or lender. Anyone with an interest in the property can ask the county court to declare it unenforceable and record that court order to clear the title.
