New survivor benefit levels for public employees' families

Beginning July 1, 2025, New York updates the special accidental death benefit for survivors of certain public employees. The law sets a new schedule that adds a percentage of the member’s salary to the benefit based on the calendar year of death. Earlier death years get higher add‑ons (for example, 1977 or prior: 313.2%). More recent years get smaller amounts (2024: 3.0%; 2025: 0.0%). Eligible survivors include a spouse, children under 18 (or under 23 if a student), or parents if there is no spouse or child. For deaths before 2025, the salary used to calculate the benefit also rises by 3%.
