This law takes effect 18 months after it became law. Agencies may issue needed rules right away so they are ready by that date.
Beginning 18 months after enactment, podiatrists may diagnose, treat, operate, and prescribe for ankle conditions. The law defines the ankle to include the ends of the tibia and fibula, their joint cartilage and ligaments, and tissues at or below the triceps surae junction. Podiatrists may also perform physical exams tied to podiatry care.
Beginning 18 months after enactment, the Department may issue a limited permit so licensed podiatrists can perform advanced ankle surgery while they train. Applicants must meet residency rules and either be board-certified or board-qualified in reconstructive rearfoot and ankle surgery by a national board the Department accepts. All work must be under direct personal supervision by a podiatrist with an advanced ankle privilege or a board-certified orthopedic surgeon.
Beginning 18 months after enactment, a podiatrist may prescribe or administer narcotics only after Department of Education certification under the commissioner’s qualifications.
Beginning 18 months after enactment, podiatrists with a standard ankle surgery privilege may do soft-tissue and bone procedures not reserved for the advanced level. Those with an advanced ankle surgery privilege may fix ankle fractures, do ankle fusion and arthroscopy, and place or remove external fixation pins and retrograde tibiotalocalcaneal rods and screws up to the triceps surae junction. Surgery on malleoli fractures requires a standard or advanced privilege. Treating complications inside the tibial diaphysis from such pins is not included.
Beginning 18 months after enactment, podiatrists may treat wounds only if they touch or stem from a foot or ankle wound within podiatry scope, and not above the distal tibial tuberosity. They may treat traumatic open fracture wounds only in hospitals under Public Health Law article 28. Podiatrists may not treat pilon fractures.
