Public access to opioid settlements

The law defines "statewide opioid settlement agreements" for New York. It covers agreements the Attorney General signs on or after June 1, 2021 to resolve claims about making, promoting, selling, dispensing, overuse, or distributing opioid products. It includes consent judgments, consent decrees, and related papers. The Attorney General must keep copies and amendments on file and let the public inspect and copy them under New York’s public records law.

Limits on new opioid lawsuits by governments

The law stops New York state and local governments from suing over claims the Attorney General releases in a statewide opioid settlement signed on or after June 1, 2021. If a government filed a case after June 30, 2019 on a claim that later gets released, that case ends by law once the release takes effect. This automatic end applies when the released party is an opioid maker, distributor, or dispenser. The rule only covers the specific "released claims" named in the settlement.
