On-duty MTA employees have a legal defense to bus lane violations under the state’s bus rapid transit program (section 1111-c). It applies only when the employee is doing authorized MTA work. They must be driving an authorized employer vehicle in the bus lane. They must be doing lawful business or providing service to an official MTA vehicle or staff. This rule takes effect immediately and ends if section 1111-c is repealed.
