Bronx parks get funding and land safeguards
As a condition of the licensed land deal, the city must dedicate at least the combined fair market value of both transferred parcels and the access rights to Bronx parks. This money must buy new parkland or fund capital improvements to existing Bronx parks and recreation facilities. If the land received federal support, the city must first meet federal requirements, including equally valuable and useful replacement land when required. If Bally’s gets a gaming license but construction does not start within 15 years after the law’s effective date, both transferred parcels return to the parks department for park and recreation use, and the access rights end. The same return and termination apply if either transferred parcel is used for an unauthorized purpose.
Bronx parkland can host a casino
Effective immediately, the law allows New York City to sell about 15.73 acres of Ferry Point Park to Bally’s at fair market value, subject to agreed terms and a state gaming license. Allowed uses include a casino, commercial space, shops, entertainment, recreation, golf, hotels, a convention center, community facilities, parking, and roads. The city can also transfer about 9.61 acres to its transportation department for public roads and grant Bally’s access rights over another 1.42 acres. That access area must stay publicly accessible and usable for park purposes, and Bally’s and later owners must restore disturbed surfaces. The law does not issue a gaming license or waive existing state gaming rules or local land-use review.
