Protections for existing titles and liens

Existing title certificates and perfected security interests keep their legal force during affixation and conversion. The DMV may not suspend or revoke a title just because the home is attached to land. While a perfected security interest remains, the DMV cannot file an affidavit of affixation, revoke the title, or issue a new title except where the law allows. A DMV title still serves as initial proof of the facts it shows after affixation. A security interest noted on the title takes priority over later liens, subject to the statute’s listed exceptions.

Surrender title or confirm conversion at DMV

You can ask the DMV to cancel a manufacturer’s certificate of origin or a certificate of title when the home is or will be on a permanent foundation. The DMV cancels it and sends written acknowledgments when your application and documents are genuine. The DMV will not accept surrender of a title until all liens and security interests are released. If you cannot find the title or the manufacturer’s certificate of origin after a diligent search, you may file the recorded affidavit of affixation plus a sworn declaration from a New York attorney or licensed title agent that the home is or will be free of recorded security interests and list any known title facts.

Turn a manufactured home into real property

A manufactured home counts as real property when it is anchored to a permanent foundation and hooked to a home utility. Ownership of the home and the land must match, or you need a recordable lease with the landowner’s written consent. Each owner must sign and record an affidavit of affixation with required details; the clerk records it and promptly forwards the recorded original for DMV filing. Your home becomes real property when the DMV accepts your surrender or conversion confirmation application; if you deliver that application within 30 days after recording the affidavit, real‑property status dates back to the recording date. After conversion, mortgages and liens that can attach to land also attach to the home, and new lien filings must follow Real Property Law Article 9‑E. Once an affidavit of affixation is recorded, the DMV does not issue a vehicle title for the home.

Extra safeguards for sales and warranties

If you hand over a manufacturer’s certificate, a title, or lien releases to help sell or finance the home, the recipient holds them in trust for you. Any warranty that applied when the home was sold still applies after conversion. No new warranty arises just because the home becomes real property.

Online, permanent records for conversions

The DMV files recorded affidavits of affixation and certain declarations after checking they are genuine. The DMV keeps records forever, including the serial number, county, recording date, and deed book and page. The public can search these affidavits, surrendered certificates, and conversion applications online.
