Stricter payroll rules for public-works contractors

Contractors and subs on public work must keep sworn payrolls with each worker’s name, address, hours, job, wage, supplements, and the required wage notice copies. Unless you file through section 220‑j, you must send a transcript within 30 days of your first payroll and every 30 days after. If you have no regular New York office and the contract is over $25,000, keep payrolls on site; others must produce them on site within five days when ordered. Willful failure to file is a class E felony, and late filings can mean up to $1,000 per day in civil penalties. Agencies collect these records, keep them for five years after project completion, and must post the name of the person who receives and reviews payrolls at the job site.

Electronic payrolls count as transcripts

Sending certified electronic payroll records that meet section 220‑j(2) satisfies the payroll transcript requirement. The agency can rely on those electronic records instead of collecting separate paper copies. Make sure your electronic filing meets the section 220‑j standards.

Public payroll databases for public works

The Labor Department must launch a public, searchable certified‑payroll database by December 31, 2025, without personal data. Fiscal officers in cities over 1,000,000 people can use it to enforce pay rules. A city over 1,000,000 can choose to build its own public database and must notify the commissioner within 30 days after this section takes effect; it must also hide personal data and give the city comptroller access. If the city does not build it by December 1, 2025, or the comptroller finds noncompliance, the state database covers city projects and contractors send records to the state. For contractors, this means more online reporting and public visibility of certified payrolls.
