AI cannot cut pay for public workers

Public employers can use AI, but it cannot change workers’ rights. School boards, BOCES, boards of trustees, SUNY, CUNY, community colleges, state agencies, and public authorities may not use AI to fire, displace, or move current staff, or to cut non-overtime hours, wages, or benefits. Existing duties may not be transferred from current employees to an AI system. Civil service status, bargaining rights, and union membership are preserved.

Bias checks before agencies use AI

Before an agency uses an automated decision tool, it completes an impact assessment signed by a responsible human reviewer. It updates the assessment at least every two years and before any material change. The agency must send each assessment to the Governor, the Senate’s Temporary President, and the Assembly Speaker at least 30 days before use, and post it online. Agencies may redact parts that would harm public health or safety, invade privacy, or weaken IT security, and must explain any redactions. If an assessment finds biased or discriminatory results, the agency must stop using the tool and any information it produced.

Public lists of government algorithms

Agencies must post a list of every automated decision tool they use by December 30 after this section takes effect, and update it each year. A state office keeps a statewide inventory and posts it on the New York Open Data site by the same December 30 schedule. Agencies must send required information at least 60 days before the annual posting. The office may withhold details that would risk IT security or as allowed by open-records law, and it sends the inventory to the Governor and legislative leaders. Within one year after this section takes effect, each agency must also give the Legislature a report on existing tools, naming the tool and vendors, start dates, purpose and the human role, and whether assessments were done.
