When a subsidy to adoptive parents is ended and the child lives with a court‑granted custodian or guardian, the agency pays that caregiver under a written agreement. Payments are retroactive to the end date and last until the child turns 21. People who lost or surrendered parental rights to that child cannot receive these payments, and caregivers must meet the same rules as adoptive parents. If the subsidy ends after age 18 but before 21 and no one else has custody, the agency pays the young adult directly if they can manage the money, or to a certified representative payee. If the youth turns 21 while waiting for a payee, they get retroactive direct payments back to the parent’s death or the post‑18 subsidy end.
The law sets clear steps before an adoption subsidy is ended. If you confirm you still have a legal duty to support your child, the agency does not cut your subsidy. If an official finds you are no longer legally responsible or not giving support (and the child is not in foster care), the subsidy ends; you can appeal. If the child is in foster care and no longer gets any support from you, the subsidy ends. If your child returns from foster care to your home, payments restart on the date the child returns.
Some new rules start only after federal approval of a Title IV‑E plan; they begin 90 days after approval. Section one takes effect on the same date and in the same way as the related 2024 law. The state child welfare agency must submit the plan change to the federal government. Agencies may adopt needed rules right away so they are ready by the start date.
