Brookhaven allows tower lease with park protections

Brookhaven can take specified land at Rolling Oaks Golf Course in Rocky Point out of park use for a wireless tower. The lease to LI Smart Solutions LLC must be at fair market value and last no more than 30 years. A 15-foot-wide access and utility route must stay publicly accessible and usable for park purposes. If the town received federal assistance for this land, it must meet federal requirements before changing its use. Those requirements include equivalent replacement land when required. All lease proceeds, plus at least the easement’s fair market value, must fund park and recreation improvements or additional facilities. If the authorized use stops, the lease and access easement end, and the land returns to public park use. The tower must be removed and the property restored to its prior state for park and recreation use.
