The Town of Brookhaven can stop treating 0.0573 acres at Rolling Oaks Golf Course in Rocky Point as parkland and lease it to LI Smart Solutions LLC for a wireless tower. The lease must be at fair market value and can last up to 30 years. The town may grant a 15-foot-wide access and utility easement along the existing road from North Country Road, but the road stays open for public park use. All lease money must fund park capital upgrades or buying more park land, and the town must invest at least the easement’s fair market value in parks. If the site stops being used as described, the lease and easement end, the tower is removed, and the land returns to park use. If these parklands received federal funds, the town must meet federal land-substitution rules first.
