The law repeals Section 793 of the labor law and renumbers Section 794 as 793. The old Section 793 protections for government call-center workers no longer exist as a standalone section. If you relied on those specific rights, they are removed. Any current protections come from the revised rules in this law and in contracts.
The law narrows who counts as a governmental body. It covers the State of New York and state public authorities, but not counties, cities, towns, or other local governments. If you work for a local government call center, these worker-retention protections no longer apply to you.
When the state replaces a call-center contractor, the new contractor can choose to keep the current workers; keeping them is optional. If you are kept, you get a 90‑day transition and cannot be fired without cause during that time. At the end of 90 days, the contractor must evaluate your performance and, if it is satisfactory, must offer you continued work. If fewer staff are needed, the contractor may hire by seniority and keep a preferential list, giving non‑retained workers first chance at openings during the 90 days. The old contractor must give the new one a list of affected workers on request; the prior 30‑day advance posting and union‑notice rule is removed. If the new contractor uses a subcontractor, it must make that subcontractor follow these same worker rules. State agencies and public authorities may include a worker‑retention requirement in call‑center contracts and bids, but they do not have to.
