The law says the New York Council on the Arts is not out of compliance when a seat is empty. The council keeps all its powers while the vacancy exists. Appointing authorities must fill the seat within a reasonable time. New picks should, when possible, move the council toward having at least one member from each of the state’s ten regions, as defined by the Empire State Development Corporation.
