New York creates a program to build the native seed supply. Three state agencies run it together. The state can fund its own growing sites or give support to private growers, if money is budgeted. Within one year of the law taking effect, the state sets rules and an initial list of eligible native seeds, and updates it at least every three years. The law aims to keep native seeds available at a reasonable cost and in enough supply. It defines native seed as non‑invasive plants native to New York or likely to move here with climate change, and includes seeds and plant parts used to grow them.
The state uses native seeds on its projects whenever possible and practical. This covers public land care, roadsides, reforestation, pollinator work, habitat restoration, and regular groundskeeping on state lands. The agencies may add other project types as they decide.
