Exemptions and equity in EV parking rules

When setting the new EV parking standards, the code council must consider equity across incomes, housing types, places, and jobs, and allow direct meter or submeter wiring for multifamily units. The council can exempt projects tied to affordable‑housing agreements, and projects that show technical infeasibility, or based on location or building type. These choices are made when the council issues the new code after December 31, 2026.

New EV wiring and chargers in new parking

Beginning when a new state building code is adopted after December 31, 2026, any new building that adds new off‑street parking must include EV‑ready wiring and some installed EV chargers. For buildings other than detached one‑ and two‑family homes, the code sets minimum numbers of EV‑ready spaces and spaces with chargers, and minimum charging power. For detached one‑ and two‑family homes, the council may require EV‑ready wiring but not full chargers. Clear signs must show where EV‑ready spaces and chargers are located. These rules apply only to new buildings with new off‑street parking.

Old EV parking mandate repealed

The law repeals the earlier Executive Law rule that required EV chargers and EV‑ready spaces in new construction with dedicated off‑street parking. The repeal and the new Energy Law timing take effect on the same date and in the same manner as a 2024 law that amended the Executive Law about EV charging in new construction.

EV rules skipped in life-cycle analysis

The law tells agencies to exclude these EV parking standards from a specific Energy Law life‑cycle analysis. This only changes how the government analyzes rules. It does not directly change what households must do or pay.
