The law protects county employees tied to these projects. It blocks displacement, cuts to regular hours, and shifting union work to contractors. It keeps current union contracts in place. New job titles created by the projects must go to the right bargaining unit. County staff can still sign off on substantial and final completion.
All construction under this law is a public work. Workers get New York prevailing wages and are covered by a project labor agreement (PLA). The design‑builder must make every contractor and subcontractor follow the PLA, and the county must monitor and enforce it. Federal prevailing wage rules also apply when federal money is used.
Westchester County can use one design-and-build contract for four named projects. These are the Labs and Research Building (10 Dana Road, Valhalla), the DPW Maintenance Facility (Hammond House Road, Valhalla), the Emergency Services Building (4 Dana Road, Valhalla), and the Public Safety Building (1 Saw Mill River Road, Hawthorne). Selection uses a two-step RFQ shortlist and then an RFP with best‑value scoring posted online. Contracts can be lump‑sum or cost‑plus with a guaranteed maximum price. GMP deals must allow audits and include scope, line‑item costs, drawings, completion dates, and unit prices.
All contracts must follow goals for minority‑ and women‑owned businesses. RFQs and RFPs can set MWBE goals and give points for certified MWBEs and small businesses. When federal money is involved, federal disadvantaged business rules also apply.
The county must file a report by June 30, 2026 and every year after. It must list each design‑build contract, the RFQ shortlist, total cost, and estimated savings from design‑build. It must also report MWBE participation rates and dollars paid.
This law takes effect now and ends three years after it took effect. RFQs issued before repeal can keep going under these rules. Plan bids and schedules within this window.
Licensed professionals must do and seal regulated design work. Projects must complete New York environmental review and, when triggered, federal NEPA review. Sending a proposal or signing a contract under this act is not a violation of Education Law §6512.
