The law makes unfair, deceptive, or abusive acts in any business or service in New York illegal. An act is unfair if it causes big harm you cannot reasonably avoid and the harm outweighs any benefit. An act is abusive if it blocks your understanding of key terms or takes unreasonable advantage of your lack of understanding or ability to protect yourself. These protections also cover harm to people other than consumers.
If you are harmed by a deceptive act, you can sue to stop it. You can recover your actual losses or $50, whichever is more. For willful or knowing violations, the court can award up to three times your losses, capped at $1,000. If you win, the court can also award your reasonable attorney’s fees.
The Attorney General can sue to stop unfair, deceptive, or abusive acts and get money back for the public. The AG can act against companies outside New York and seek quick court orders when needed. Before suing, the AG usually gives notice and five business days to respond, unless fast action is in the public interest. The AG can take testimony and issue subpoenas to gather proof. This law works alongside other state laws and does not replace them. Money recovered by state agencies under this law follows state finance rules.
Businesses that follow applicable federal rules have a complete defense under this law. TV and radio stations, and publishers or printers, are not liable here for ads they carry. These limits narrow who can be sued under this statute.
