New cost rules for HSA high‑deductible plans

For HSA-linked high-deductible plans, some services that New York normally protects from deductibles can be put under your plan’s deductible to keep the HSA valid. You pay the deductible first, then regular copays or coinsurance apply. Preventive care stays covered under preventive rules, even before you meet the deductible. Starting January 1, 2027, this applies to policies issued, renewed, or changed on or after that date.

Prescription discounts count toward your costs

Insurers must count coupons, copay help, and other discounts for certain drugs toward your deductible, copays, coinsurance, and out-of-pocket max. For HSA-linked high-deductible plans, that counting toward the deductible starts only after you meet the deductible. Preventive drugs follow preventive-care rules. This applies to covered generics, brands without a generic, and brands you get by prior authorization or appeal. It starts January 1, 2027 for policies issued, renewed, or changed on or after that date.

When these HSA plan rules start

The law is in effect now. But the insurance changes for high-deductible plans and HSAs start January 1, 2027. They apply to policies issued, renewed, modified, altered, or amended on or after that date.
