Employers can use credit history in hiring

The law repeals a 2025 rule that banned using a person’s credit history in hiring. Employers, including state and local governments, can now request and use credit reports for job decisions, subject to other applicable laws. Jobs that require a state agency background investigation are treated as an exception and can include a credit check. The law defines “employer” to include any business with employees and public entities. It takes effect on the same date as the related 2025 act.
