The law covers no-fault separation when one spouse swears the marriage broke down for at least six months. The court does not grant a separation judgment until all timely, relevant money and custody issues are resolved by the parties or decided by the court and included in the case. Issues can include spousal support (or a waiver), child support, attorney and expert fees and expenses, and custody and visitation for the children of the marriage. The court makes sure these are handled before entering the judgment.
