Narrower consumer protection against unfair practices

The law repeals General Business Law §348, which the 2025 FAIR Act added. It narrows what counts as an unfair practice: it must cause, or be likely to cause, substantial injury that people cannot reasonably avoid and that is not outweighed by benefits to consumers or competition. “Substantial injury” has the same meaning as under the federal FTC Act. The law removes language that treated harm to non‑consumers as substantial injury. It also repeals paragraph (3) of §349(b), changing remedies or enforcement under this section. These changes take effect on the same date as the 2025 FAIR Act.

Longer response time before Attorney General lawsuits

Before suing under this law, the Attorney General must send notice by certified mail. The person has 10 calendar days after getting the notice to reply in writing. The Attorney General can skip notice when seeking quick, preliminary court relief and notice is not in the public interest. This change takes effect on the same date as the 2025 FAIR Act.
