How New York enforces these warnings

Starting January 1, 2027, the Attorney General sets rules to carry out and enforce this law. The Attorney General can sue to stop violations and get restitution, disgorgement, damages, and civil penalties up to $5,000 per violation. The Attorney General also runs a public website to collect complaints and tips about platforms that do not follow the law.

Mental health warnings on addictive features

Beginning January 1, 2027, platforms with addictive features must show a Surgeon General warning to users in New York. When you first open the platform each day, the warning shows for at least 10 seconds and covers at least 25% of the screen. After 3 hours of active use, it shows for at least 30 seconds and covers at least 75% of the screen, then at least once per extra hour. You cannot skip or bypass it. Platforms cannot hide the warning in terms of service, reduce its visibility, or design around the rule. The rule applies when you are physically in New York and not when you are outside the state. A platform does not have to show the warning if it reasonably determines you are over 17. Platforms cannot lower service quality or raise prices because the warning appears, except as needed to follow the law.

Start date and repeal of old rule

The law takes effect January 1, 2027. State officials, including the Attorney General, can adopt or change rules now so the law is ready on time. On that date, the older mental hygiene law section on warning labels is repealed and replaced by this framework.
