Felony for stealing telecom copper

The law makes it a Class D1 felony to enter any premises, easement, or right-of-way without consent to steal copper wire, cable, or tubing used by or marked as belonging to phone, internet, broadcast, or wireless companies. If convicted, a person faces prison as state law provides, a fine of $100 to $500, or both. This applies starting November 1, 2026.

Harsher penalties for big copper theft

Copper theft that causes $100,000 or more in damage is a Class C2 felony. If convicted, a person faces prison as Oklahoma law provides and a fine up to $50,000, or both. This applies starting November 1, 2026.

New prison ranges for Class C2 felonies

For Class C2 felonies, the basic prison term is up to 7 years. You must serve at least 20% before release, including electronic monitoring. With one or two prior Class C or D convictions, the range is 2 to 10 years with at least 20% served. With three prior Class C/D or any prior Class Y, A, or B conviction, the range is 2 to 12 years and you must serve at least 40%. Some specific crimes listed in law are exempt from these enhanced ranges and keep their old penalties. One listed crime is exempt from one enhancement but not the other. Fines still apply as set elsewhere in Oklahoma law. These rules take effect November 1, 2026.
