Strangling a partner is a felony

Beginning November 1, 2026, strangulation or attempted strangulation against an intimate partner or family or household member is a Class B5 felony. Conviction brings 1 to 10 years in state prison, a fine up to $20,000, or both. This raises penalties to protect victims.

Tougher penalties for partner assault

Beginning November 1, 2026, assault or battery against a current or former intimate partner, or a family or household member, is punished as domestic abuse. A first conviction can mean up to 1 year in county jail, a fine up to $5,000, or both. A second or later conviction is a Class B5 felony with up to 4 years in state prison and a fine up to $5,000.

Tougher penalties when children witness abuse

Beginning January 1, 2026, a second or later conviction for domestic abuse in a child’s presence is a Class B5 felony. Beginning November 1, 2026, a first conviction for abuse in a child’s presence carries 6 months to 1 year in county jail, a fine up to $5,000, or both. A second or later conviction then brings 1 to 5 years in state prison, a fine up to $7,000, or both. These changes aim to protect children and families.
