10-day window to seek reconsideration

Beginning November 1, 2026, if your new original permit application is finally denied and no final order was issued, you may petition the Department for reconsideration within 10 days. The Executive Director decides the petition under Oklahoma law.

Faster responses to Tier II comments

Beginning November 1, 2026, for Tier II drafts that got comments or had a public meeting, the Department must issue a written response to comments within 45 days after the comment period closes. The Executive Director may extend this deadline only for circumstances outside the Department’s control.

Tier III hearing rights and timelines

Beginning November 1, 2026, when the Department issues a proposed Tier III permit, people with a direct, adverse environmental interest have 20 days to request an administrative hearing. If no one files in 20 days, the Department issues the final permit. If a hearing is requested, the Department holds a prehearing conference within 45 days after the request window ends. If the Department later reverses its initial draft decision, it must withdraw the old draft, re‑notice the new draft, reopen public comments, and offer another chance for a public meeting.

More notice and online access for permits

Beginning November 1, 2026, Tier II and Tier III applicants must publish a legal notice in one local newspaper once a week for two weeks and point people to the Department’s online docket. The Department keeps the application and draft permit on the Electronic Environmental Permitting Docket and makes them available in the county, except proprietary parts protected by law. After technical review, the Department posts a draft permit or draft denial and opens a 30‑day public comment period (longer if federal rules require). For Tier III, the publication must offer a 30‑day chance to request a process meeting or list the meeting’s details; if there is strong public interest, the Department holds the meeting. The Department gives at least 30 days’ advance notice for any formal public meeting and holds it within 75 days of the draft notice unless the applicant asks for more time. After a final Tier III decision, the Department publishes a final notice and says where to find any response to comments.
