Arts Council contracting and funding safeguards

Beginning November 1, 2026, the Oklahoma Arts Council can contract with state agencies and 501(c)(3) nonprofits with valid IRS 501(a) status. Nonprofits must show their goods or services match state arts policy in Section 162. The Council must post public notice, accept written applications, act on them, and require proof of completion on its form signed by managing officers. Council funds cannot be used, directly or indirectly, to support churches, sectarian institutions, or religious leaders.

Historical Society contracts and safeguards

Beginning November 1, 2026, the Oklahoma Historical Society can contract with state agencies, 501(c)(3) nonprofits with valid IRS 501(a) status, and with individuals or associations for historical work. The Society must offer a way to submit written applications and act on them. At the end of each contract, the contractor must file proof of completion on the Society’s form, signed by its managing officers. Society funds cannot be used, directly or indirectly, to support any church, sect, denomination, religious system, clergy, or sectarian institution.

J.M. Davis museum contracts and limits

Beginning November 1, 2026, the J.M. Davis Memorial Commission can contract with state agencies, 501(c)(3) nonprofits with valid IRS 501(a) status, and with individuals or associations for its work. The Commission must accept written applications, act on them, and require proof of completion on its form signed by managing officers. Commission funds cannot be used, directly or indirectly, to support churches, sects, or religious leaders. The Commission cannot approve hiring, purchases, or construction unless money is already appropriated or actually received as gifts, grants, or contributions.
